Rental Agreement
This Rental Agreement is entered into between:
Saksi Studios (“Saksi”, “we”, “us”, “our”)
And
You (“you”, “your”, “the Hirer”)
Collectively referred to as “The Parties”.
Rental item
The rental item is a camcorder and associated accessories (the “Equipment”) supplied by Saksi. A full inventory of items included in your rental package will be provided upon dispatch.
Rental period
The rental period begins on the date the Equipment is delivered to you and ends on the agreed return date. If the Equipment is not returned within 7 days of the agreed return date, Saksi reserves the right to charge the full replacement cost in addition to any accrued late fees.
Rental fees and security bond
You agree to pay the rental fee in full at the time of booking. A refundable security bond (amount specified at booking) may be required to cover loss or damage. The bond will be refunded within 7 working days of the Equipment being returned in satisfactory condition.
Delivery and return
Saksi will arrange delivery of the Equipment to the address you provide. You are responsible for ensuring someone is present to accept delivery. You must return the Equipment in the provided packaging, using the pre-paid return label, by the agreed return date. Late returns will incur daily late fees at the rate specified at booking, and may result in forfeiture of your bond. You assume all risk for the Equipment until it is received and inspected by Saksi.
Content Responsibility & Equipment Use
Equipment Care
You agree to use the Equipment only for its intended purpose and in a careful and responsible manner. You must store the Equipment securely when not in use and protect it from damage, loss, or theft. You may permit other guests at the event to use the Equipment, provided that you remain fully responsible for its care, condition, and return. You must not sublet the Equipment, or allow anyone outside of the event to use it. You must not tamper with, alter, or attempt to repair the Equipment.
Prohibited Actions
You must not copy, alter, tamper with the SD card. Any loss, file corruption, deletion, or damage to footage caused by your actions will be your responsibility. Saksi will not be liable for lost or damaged footage resulting from your misuse of the Equipment or files.
Footage & Content Responsibility
You are solely responsible for capturing footage during your rental period. Saksi is not liable for the amount, quality, or usability of footage recorded. If you do not use the Equipment, or record insufficient or unusable footage, you are not entitled to any refund, credit or reshoot.
Acknowledgement of Responsibility
By taking possession of the Equipment, you confirm it is in full working order and complete. Any missing, corrupted, or unusable footage will be presumed to result from your actions, unless you provide evidence otherwise. Saksi’s liability is limited to repair or replacement of the Equipment and does not extend to lost, corrupted, or unusable footage.
Customer Confirmation
By booking and accepting the Equipment, you acknowledge that you have read, understood, and agree to these responsibilities. You accept that Saksi cannot guarantee the creation of any specific content or video outcome.
Damage, Loss and Theft
You are fully responsible for the Equipment from the time it is delivered until it is returned to Saksi. If the Equipment is lost, stolen, or damaged (other than normal wear and tear), you will be liable for the full replacement or repair cost. If damage occurs, you must notify Saksi immediately and not attempt repairs yourself. Saksi will not be liable for loss, damage, or theft caused by third parties if the Equipment is loaned or transferred without permission.
Condition on Return
All Equipment must be returned in the same condition it was received, with all accessories and packaging. Any missing or damaged items will be charged to you at replacement cost, deducted from your bond or invoiced separately.
Liability and Indemnity
You use the Equipment at your own risk. Saksi will not be liable for any loss, injury, or damage to persons or property arising from your use of the Equipment. You agree to indemnify and hold harmless Saksi from any claims, damages, or expenses arising from your use or misuse of the Equipment, including any third-party claims. You must follow all instructions and guidelines provided by Saksi for the use of the Equipment. Failure to do so may result in liability for damages.
Equipment malfunction
Saksi makes reasonable efforts to ensure the Equipment is in full working order. Saksi is not responsible for unforeseen technical failures beyond its control. In the event of malfunction, Saksi may replace or repair the Equipment at its discretion, but is not obliged to provide a refund for lost or unusable footage.
Media rights & Intellectual Property
All raw footage remains your property. Any edited videos produced by Saksi may be used for Saksi marketing purposes with your consent. You agree not to reproduce, sell, or distribute edited works created by Saksi without permission.
Booking Accuracy
All bookings must be made with accurate event details. Misrepresentation of dates, events, or other information may result in cancellation without refund or additional charges.
Cancellation Policy
Cancellations more than 30 days before the rental start date will receive a full refund. Cancellations within 30 days are non-refundable unless agreed otherwise at Saksi’s discretion.
Ownership
The Equipment always remains the property of Saksi. This Agreement does not transfer any ownership rights to you.
Privacy
Saksi will collect and store your personal information for the purpose of fulfilling this Agreement. Your data will be handled in accordance with our Privacy Policy.
Governing Law
This Agreement is governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
Acceptance
By booking and paying for a rental, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
